General Terms and Conditions of Sale

The general terms and conditions of sale described below are intended to govern all contractual relations between CLIMALED.FR, a commercial brand of SAS CLIMALED whose registered office is located at 247 Rue Albert - 94500 Champigny-sur-Marne, RCS Créteil B 801 589 003, and customers wishing to place orders.

The fact, for any customer, to place an order, implies his acceptance without reserve of the present general conditions of sale. If a condition were to be lacking, it would be considered to be governed by the customs in force in the sales sector.

Rule No. 1 - Products

The customers are informed on the Internet site of the essential characteristics of the products. However, the customers are invited to take note of the instructions for use or any other information attached to the product or carried on the product or its packaging (precautions for use, conditions of use ....). It is reminded that the photographs illustrating, in support of the text, the products, do not enter the contractual field. Also, if errors are made, CLIMALED.FR cannot be held responsible.

Rule No. 2 - Price

Pour tous les produits les prix affichés sont exprimés en TTC hors éventuelle participation aux frais d’envoi. Les prix sont susceptibles d’être modifiés à tout moment. Ces prix sont applicables en exclusivité dans le cadre de la vente à distance et ne sont pas applicables en magasin. Une facture, servant le cas échéant de garantie, est adressée pour chaque commande.

Rule No. 3 - Payment Methods

The products and any contributions to shipping costs are payable at the time of purchase.

You can pay for your purchases by credit card (via the secure Payplug platform), by bank or postal check, bank transfer and PayPal.

Rule No.4 - Shipping Costs

All orders under 250€ Vat Incl. will be charged a contribution to the shipping costs. This contribution to shipping costs will be calculated automatically during the purchase process and mentioned in the shopping cart.

Any order equal or superior to 250€ Vat Incl with deliveries in Metropolitan France is exempted from participation in the shipping costs. Deliveries outside this territory have specific costs depending on the recipient.

Rule No.5 - Order Confirmation

CLIMALED.FR will send an order confirmation email to the customer upon receipt of the order.

The customer's order is considered accepted only after its validation by CLIMALED.FR.

Some orders may be subject to additional requests to the customer. In particular equipment containing refrigerants.

In this case, the customer is notified by email of the supporting documents to be sent in order to obtain the final validation of his order.

CLIMALED.FR reserves the right to cancel the order in case of non-receipt of these supporting documents or in case of receipt of documents judged not in conformity.

The customer's order may be cancelled by CLIMALED.FR, for any reason whatsoever, particularly in the event of lack of information necessary for delivery.

The customer will be informed by CLIMALED.FR.

Rule No. 6 - Delivery

Deliveries are made to the address indicated by the customer (excluding Saturdays, Sundays and public holidays).

Our carriers are mandated to drop off the packages, in your presence, in front of your house, or, at the foot of your building. The delivery service does not include the installation and/or collection of the old equipment and the delivery of the new device is only done at ground level, i.e. in the case of a delivery to places where access is by stairs / elevators, the device is left at the door of the building (building, shopping center, ...)

In the case of a delivery with several brands of products, will have to wait until all the articles are available or this one can be made in several times.

CLIMALED.COM shall not be held responsible for the consequences of any event beyond its control, in particular any case of force majeure or the fault of the carrier or the manufacturer, which would tend to delay or prevent the delivery of the ordered products.>

Delays in delivery can in no case result in the payment of damages to the customer or his service providers. 

Upon receipt of the goods, the customer must carefully check the package(s) and verify the contents in the presence of the delivery person before signing the delivery note.

Rule No. 7 - Right of Withdrawal

Pursuant to Article L 121-20 of the Consumer Code, the customer has a withdrawal period of 14 days from the delivery of products ordered on our website.

After informing us of your decision, you have a maximum of 14 days to return the goods.

Notification of the right of withdrawal

Simply returning the goods or refusing to take delivery is not sufficient to express your wish to withdraw. You must send us the standard form of withdrawal or another writing expressing your desire to withdraw.

Rule No. 8 - Return Policy

It is the responsibility of the consumer to bear the cost of return. For customers located in metropolitan France, we have the forwarding service for a value of 5% of the total order with a minimum of 60 € TTC.

You can also return your order using a carrier of your choice. Please note that our return address is as follows:

Return Conditions

If you have decided to return a product, you must ensure that it has been kept in its original condition and packaging. The product must be returned to us accompanied by all accessories and any instructions.

Will be refused returns of products that have already been installed or that show damage to the article or its packaging. Damaged, torn or written packaging also cannot be returned.

Refund

We will refund you within 14 working days from the date we were notified of your wish to withdraw, this period may be deferred until the day we receive the product(s) returned to the address mentioned above.

CLIMALED.FR reserves the right to deduct from the refund any amount for returned products that would be damaged. You will be reimbursed for the amount corresponding to the price of the returned products, excluding delivery costs, if any, except in case of use of the right of withdrawal.

Rule No. 9 After Sales Service - SAV

The customer must address us by telephone, e-mail address [email protected] or via the heading "Contact" to our service department.

Climaled.fr then sends the customer an after-sales service form to fill out and attach to the installer's report, indicating the tests performed and the defective parts.

All you have to do is send us the after-sales service form we sent you so that we can send you the parts needed for the repair, whether covered by the warranty or not.

Rule No. 10 - Legal Warranty of Conformity and Manufacturer's Warranty

CLIMALED.fr as a distributor, all our products benefit from the legal guarantee of conformity (articles L217-1 and following of the Code of consumption), guarantee against the hidden defects (articles 1641 and following of the Civil code) and also the Guarantee of the Manufacturer.

All products are also carefully tested before they are put on the market. However, if you notice a defect, you have an extended warranty period for a number of products - in addition to the legal warranty of 2 years.

If a problem is found to be due to the equipment and not to a faulty installation or use, we will provide the necessary replacement parts to our customer free of charge, in accordance with the warranty we provide.

Warranty Terms and Excluded Items

The guarantees are valid from the date of delivery.

For the guarantee to be valid and accepted, in accordance with Article R543-78 of the Environmental Code is imposed for all items containing refrigerant that its commissioning is carried out by an authorized refrigeration professional.

The warranty does not apply to items that have been improperly stored, assembled or installed, used improperly, misused, altered or cleaned by improper methods or with improper cleaning products. The warranty does not apply if the item has been used in a public place or if it has been placed outdoors or in an environment that may cause corrosion. It also does not cover accidental damage.

CLIMALED.FR could not be held responsible in case the conditions mentioned above were not respected or in case of refusal of the manufacturer to apply its guarantee.

Labor, transportation, technician travel, communications to the hotline of the brands are not covered by the warranty.

Rule No11 - Reservation of Ownership

The delivered products remain the property of CLIMALED.FR until full and effective payment of the price by the customer (effective receipt of payment by CLIMALED.FR).

Rule No. 12 - Integrity

In the event that one of the clauses of this contract would be null and void by a change in legislation, regulation or by a court decision, this would in no way affect the validity and respect of these general conditions of sale.

Rule No. 13 - Duration

The present conditions apply throughout the duration of the online services offered by CLIMALED.FR. They can be modified at any time by CLIMALED.FR.

Rule No. 14 - Applicable Law and Jurisdiction

The present conditions are subject to French law. Disputes arising from the application of these general conditions of sale are subject to French law and only the French courts can judge them.

The disputes between CLIMALED.FR and all customers are of the competence of the commercial court of Créteil, notwithstanding plurality of the defendants and/or call in guarantee, even for the procedures of urgency or the conservatory procedures in summary or by request.

Rule No. 15 - Proof

The submission of the credit card number on our secure payment site is proof of the completeness of the order.

In all cases, the provision of the credit card number and the final validation of the order will be worth proof of the completeness of the said order in accordance with the provisions of the law of March 13, 2000 and will be worth the sums committed by the selection of the articles appearing on the order form. This validation is worth signature and express acceptance of all the operations carried out on the site.

The computerized registers, kept in the computer systems of the company CLIMALED.FR in reasonable conditions of safety, will be regarded as proof of the communications, the orders and the payments occurred between the parts.

The filing of the estimates, orders and invoices is carried out on a reliable and durable support so as to correspond to a faithful and durable copy in accordance with article 1348 of the Civil code.

Rule No. 16 - Confidentiality

The information communicated on the website will only be used to process your request and will remain strictly confidential. In application of article 40 of the law 78 - 17 of January 6, 1978 relating to data processing, files and freedoms, you have the right to consult, modify, rectify and delete the data you have communicated.

The information you are asked to provide will be used for a global and non-nominative purpose and will not be used for any other commercial purpose nor given to third parties, the file being declared to the CNIL.
